Bidders are responsible for making a determination as to the items condition and value from inspection prior to bidding. Inability to observe defects or deficiencies in a lot through inspection is a risk inherent in the auction process and will not be basis for any refund or adjustment in the sales price. Failure to view/inspect any property for sale shall not constitute cause of cancellation of sale. It is hereby warned that bidders should not bid on the basis of photography alone. All sales are recorded and any discrepancies will be settled after the conclusion of auction.

By placing a bid, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. Bidder expressly agrees not to stop payment, dispute or contest this transaction. FAILURE TO PAY FOR ITEMS WILL RESULT IN DENIAL FROM PARTICIPATION IN ANY FUTURE Gaston & Sheehan AUCTIONS.

All descriptions are believed to be correct; however neither Gaston & Sheehan Auctioneers assumes any liability as to the accuracy of any descriptions, quantity, weight, grade, quality, purity, value or any other feature(s). No allowance, refund or set aside will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type.

The Buyer specifically agrees and acknowledges that the use of the term “tested” as used to describe articles of jewelry means only that the Auctioneer believes that the article described has been tested as to the gold or silver and the Auctioneer makes no warranty that the gold or silver content is as described. Likewise, the description of a diamond or other gem or the description of a particular brand does not constitute any representation or warranty that the article is as described. It is the Buyers sole responsibility to determine the authenticity of any item purchased.

The Auctioneer has the right to reject any and all bids on behalf of the Seller and to bid as agent for any Absentee Bidder. The Auctioneer is not responsible for the acts or representations of the Seller. Seller shall retain full security interest in all merchandise until full and complete payment is made to Seller or Gaston & Sheehan Auctioneers.

Security for purchases is the responsibility of the Buyer and begins immediately upon the sale of each lot. Removal is at the expense, liability and risk of the Buyer. Auctioneer shall not be responsible for goods not removed within the specified time period. Auctioneer shall not be responsible for non-delivery or for any other matter or thing to any purchaser of any lot, in any event. The Auctioneer retains the right to reject any bids for any reason or to make counter offers or accept back up offers at their sole discretion.

REGISTRATION & BIDDING OPTIONS:

Live Bidding: To bid you must register and obtain a bid card. Registration will be sale day, December 12th starting at 8:30 A.M. CST. To register you will need a valid photo ID and a $250 cash deposit. Deposits for unsuccessful bidders will be returned in the same form when exiting.

Upon the conclusion of the auction or bidding; Buyers will be required to verify purchases, make final payment and/or discuss final payment arrangements and receive checkout instructions prior to exiting the auction facility.

Online Simulcast Bidding: To bid you can register at www.TxAuction.com and submit a $500 deposit no later than 5:00 P.M. CST, on Wednesday, December 11th to Gaston & Sheehan Auctioneers, Inc. by any acceptable payments listed below. Deposits for unsuccessful bidders will be returned by ACH bank credit or company check within ten business days from auction.

Pre-Bidding: Written bids will be accepted until Wednesday, December 11th at 5:00 P.M. CST with a $500 deposit.

ACCEPTABLE PAYMENTS:

Cash, Cashiers Check(s), Money Order(s), Personal or Company Check with an original verified bank letter of guarantee, ACH Bank Debit or Bank Wire. All purchases paid by ACH or wire will be held until funds are confirmed and are accessed a $10 fee per Bank Wire and $5 fee for ACH Bank Debit. Credit Cards will be accepted for DEPOSITS ONLY with a non-refundable 3% fee.

FULL payment is due Wednesday, December 18th. 8.25% Sales Tax is applicable for all merchandise retrieved in Texas if a resale tax number is not provided.

MERCHANDISE REMOVAL & SHIPPING:

Paid merchandise can be removed when convenient until 5:00 P.M. CST on auction day and by appointment Monday - Friday thereafter. Buyers will be provided an invoice with shipping quotes if applicable. We utilize UPS, FedEx, USPS with Insurance and Adult Signature Confirmation. Armored transportation can be quoted if desired.
